A National Plan of Action has been adopted.as a way forward in dealing with drug and substance abuse. Its key compnents includes that the Law Enforcement Units specialized in drug and substance abuse response be decentralized coupled with equipping the Zimbabwe Republic Police’s Forensic Laboratories by the end of the Second Quarter.

Cabinet considered and approved the Report on Drug and Substance Abuse. 
Drugs and substances worth Z$438 654 692 were intercepted under Operation Clean-Up Zimbabwe with 6 156 accused persons being arrested and prosecuted across the country. A lot of people were reached with anti-drug information dissemination and campaigns in hotspot areas through Provincial and District structures. An out-patient rehabilitation and psyco-social support centre has since been established in Harare and similar centres will be set up in other provinces. Assessment visits made to ports of entry and exits to ascertain illegal drug and substance trafficking.

Recommendations to investigate Justice Mushore came from JSC after she failed to report for duty for nine months. Home Affairs minister Kazembe Kazembe ordered the Harare passport office to open on Saturdays as he launched the new passport centre in Bulawayo. Kazembe said opening the Harare registry on Saturday would help clear long queues which are a common feature. He said part of the efforts to decongest the Harare passport office included decentralising the issuance of passports as Bulawayo became the second centre to receive the machines for printing the redesigned passport booklets.

Cabinet has considered and approved the Prisons and Correctional Services Bill, 2022. The Prisons and Correctional Services Bill, 2022 seeks to modernize the prisons legislation with a view to ensuring that it meets the international norms and standards regarding prisons administration, including the way prisoners should be treated. This includes focusing on restorative justice through rehabilitation rather than incarceration of offenders. The Prisons and Correctional Services Act will ensure that the prison system caters for the needs of vulnerable groups such as pregnant women, juvenile offenders as well as persons with disabilities and other special categories in society that have special needs

Approval of the Government Enterprise Architecture Framework Approach.

Cabinet considered and approved the Government Enterprise Architecture Framework Approach to the Modernisation and Improvement of the Government of Zimbabwe’s ICT Ecosystem. The nation is informed that this Framework will digitalise Government operations in a more comprehensive and integrated manner, and it will ensure that internal ICT sub-systems located within various Ministries, Departments and Agencies (MDAs) are interoperable and coordinated. The Government Enterprise Architecture provides the critical link of all Government subsystems to the National Data Centre (NDC), which was launched by His Excellency the President last year.

Preparations for the 2022 Census underway.

31 000 tablets to be used during the 2022 Census have been delivered. Census mapping has covered about 84.6% of the country and is expected to be complete by 21st January 2022. Provincial and district census structures have been set up and Zimstats is sensitizing structures to be prepared for the census. Training of enumerators of the pilot census is in progress.

Approval of the Labour Amendment Bill

Cabinet approved the Labour Amendment Bill. The Bill aligns the Labour Amendment Act to Section 65 of the Constitution of Zimbabwe Amendment (No. 20) Act 2013, and to the ratified International Labour Organisation (ILO) Conventions. The Bill, also provides for the rights to fair and safe labour practices and standards. The amendments also makes provision for the promotion of the ease of doing business in the labour market through the streamlining of the labour dispute settlement and retrenchment processes. The Bill also takes care of emerging issues in the world of work such as labour broking, violence and harassment at the work place and emerging forms of employment relationships with a view to closing the lacuna in the existing legislation thus entrenching fair labour standards contemplated in section 65 of the Constitution. Provisions are also made to deal with “gender-based violence” and other cases of violence and harassment at the work place.

Approval of the Principles for the Electronic Transactions and Electronic Commerce Bill

Cabinet approved the Principles for the Electronic Transactions and Electronic Commerce Bill. The development of information communication technologies in cyberspace requires that the legal and policy environment be adapted to take into account the relevant changes. There is need for a holistic electronic transaction regulation regime in the face of the opening up of markets and movement of goods and services across borders, and growing incidences of scams and unfair practices, which leave the end-user at risk. The Electronic Transactions and Electronic Commerce Bill will attune the country’s legal framework to technological changes by addressing the current deficiencies in most of the country’s existing laws, which were designed for paper-based transactions. The Bill will promote and advance the business environment in Zimbabwe by establishing a legislative framework that enables fair, accessible, responsible and sustainable online transacting. The Bill will, in whole or in part, consolidate and harmonise existing electronic transactions-related legislation, such as the Consumer Contracts Act [Chapter 8:03].

Cabinet approved the Administrative Justice Amendment Bill, 2021. The purpose of the Administrative Justice Amendment Bill is to align the Administrative Justice Act to the Constitution of Zimbabwe Amendment (No. 20) Act 2013 and consequently establish a more effective and efficient administrative justice delivery system impacting positively on the principles of good governance.

Approval of the principals to ammend the Rural Electrification Act (Chapter 13:20)

Cabinet received and approved the principles to amend the Rural Electrification Act [Chapter 13:20] to align it to best practice. The amendments will seek, among other provisions, to provide for: a) expanding the mandate of the Fund to include diverse sources of energy; b) giving the Rural Electrification Agency (REA) legal recognition as the implementing arm of the Fund; c) rationalising the composition and functions of the Board; and d) allowing REA to implement its projects and reduce on contracting out; Under the amended Act, the number of civil servants who sit on the REA Board will be reduced in conformity with the provisions of good corporate governance, as contained in the Public Entities Corporate Governance Act (Chapter 10:31), and there will be gender parity in the membership of the Board. The amendments will also provide for the appointment of the Chief Executive Officer, and for the renaming of the Rural Electrification Agency to the Rural Energy Agency.

Approval of the Children’s Amendment Bill, 2021

Cabinet considered and approved the Children’s Amendment Bill, 2021. The Children’s Amendment Bill will be amended to align it with the 2013 Constitution and incorporate provisions of International Conventions and treaties that Zimbabwe has ratified. The Bill widens and criminalises instances of child abuse to include allowing a child to reside in or to frequent a brothel; causing the seduction, abduction or commercial sexual exploitation of a child; and causing a child to participate in the propagation of child sexual abuse material. The denial of medical treatment or access to medical treatment to a child without reasonable cause will also be criminalised.

Approval of the Child Justice Bill, 2020.

Cabinet considered and approved the Child Justice Bill, 2020. The Bill will establish a Child Justice System for children in conflict with the law, in accordance with the values and principles underpinning the Constitution and the international obligations of Zimbabwe; seeks to entrench the principles of rehabilitation and restorative justice as an integral part of the child justice system, and to establish procedures for the screening of children to create special rules for a Child Justice Court. The Bill will provide for legal representation for children; and the sentencing options available for children. The age of criminal responsibility of a child is being reviewed upwards from 7 to 12 years. The Bill also provides for the establishment of child justice committees at national, provincial and district levels that will be mandated with monitoring child justice.

Development of the Wetland Management Framework

The development of the Wetland Management Framework is on course, with the Wetlands Management Guidelines having been validated and adopted by the Ministry of Environment, Climate, Tourism and Hospitality Industry. The draft National Wetlands Map has been produced and validated, while the One Wetlands Policy now awaits approval by Cabinet. Four of the planned 14 waste drop-off sites were under construction at Mbalabala Business Centre in Umzingwane District, Mvurwi Town, and two in Harare Metropolitan Province.

National Development Strategy 1 Communication Strategy

Cabinet considered and adopted the National Development Strategy 1 Communication Strategy. A sustained national information campaign targeting the entire nation on the National Development Strategy 1 (NDS1), the national blueprint which Government is implementing to move the country towards the attainment of Vision 2030. The aim is to raise citizens’ awareness about NDS1, and to raise public participation in the implementation of Government policies, programmes and projects designed to develop the country towards a prosperous and empowered upper-middle income society by year 2030. This will be undertaken through NDS1 and its successor, NDS2. Appropriate messages will be disseminated to targeted audiences using available communication platforms embracing billboards apparel and collateral messaging as well as digital media.

The prison was officially opened with 30 female inmates and is estimated that once fully operational, it will accommodate 500 prisoners.

World Freedom index ranking

Zimbabwe has been ranked at 130 out of 180 countries in 2021 compared to its ranking at 126 in 2020, new rankings by the Reporters Without Borders (RSF). The report, however, also notes some positive developments. RSF noted that on assumption of office, President Emmerson Mnangagwa promised to reinforce the pillars of democracy including the media, which were harassed and gagged for 37 years under Mugabe.RSF noted that access to information has improved and self-censorship has declined, but journalists are still often attacked or arrested.

Cabinet considered and approved the Provincial Metropolitan Councils Bill, which was presented by the Minister of Justice, Legal and Parliamentary Affairs, as Chairman of the Cabinet Committee on Legislation. Cabinet was informed that the current Provincial Councils and Administration Act [Chapter 29:11] should be amended to align with the Constitution. Chapter 14 of the Constitution provides for matters to do with the creation of Provincial and Metropolitan Councils in line with the principles of devolution"

Approval of the Public Finance Management Amendment Bill

Cabinet considered and approved the Public Finance Management Amendment Bill, 2021 which was presented by the Minister of Justice, Legal and Parliamentary Affairs as Chairman of the Cabinet Committee on Legislation. Public Finance Management Act, Chapter 22:19 so as to align it to the Constitution. Through the amendments, there shall be provision for provincial and metropolitan councils and local authorities, and for Parliamentary oversight of State revenues and expenditure; seeks to improve management of public funds

Cabinet considered and approved the Police Amendment Bill, which was presented by the Minister of Justice, Legal and Parliamentary Affairs, as Chairman of the Cabinet Committee on Legislation. Seeks to align provisions of the Polic Act with the constitution.

Presentation and adoption by cabinet of the National Security Council Bill

The Minister of Justice, Legal and Parliamentary Affairs presented the National Security Council Bill, which was adopted by Cabinet. The Bill is in fulfilment of Section 209 of the Constitution, which provides for the Council. The Bill stipulates the membership and functions of the National Security Council as well the general framework for the operations of the Council. Highlights of the provisions include addition of commanders of the security services, the Chief Secretary to the President and Cabinet, and the Ministers responsible for intelligence, security, defence, police, prisons, finance and foreign affairs to the Council’s membership. The Bill also provides for reports on national security to be made by the President to Parliament each year.   

Approval by cabinet of the Zimbabwe Independent Complaints Commission Bill, 2020

Cabinet considered and approved the Zimbabwe Independent Complaints Commission Bill, 2020 as presented by the Minister of Justice, Legal and Parliamentary Affairs. The Bill seeks to provide for an independent complaints mechanism for members of the public, against members of the security service pursuant to Section 210 of the Constitution. Cabinet noted that the complaints mechanism is to be intermediated by a body which is independent of each of the security services. 

Enactment of Freedom of Information Act

The new Freedom of Information Bill became law after being gazetted following the approval of the final amended version from Parliament by President Mnangagwa.The new Act, a giant step forward in the reform agenda, repeals the long-criticised Access to Information and Protection of Privacy Act (AIPPA) and brings Zimbabwe’s information-related laws into conformity with the Declaration of Rights in the Constitution.

Approval of Recruitment of 200 Prosecutors by the National Prosecuting Authority (NPA)

The National Prosecution Authority (NPA) has been given the nod to recruit 200 public prosecutors for special anti-corruption courts across the country.

The development comes as prosecutors seconded to the NPA by the uniformed forces have since returned to their work stations following last year’s Constitutional Court ruling that employment of serving members of security services was unconstitutional.

Commencement of preparations for the delimitation process.

The Zimbabwe Electoral Commission (ZEC) has begun preparatory consultations to draw boundaries that will be used for the next harmonised elections.

While the delimitation exercise is usually conducted after the national population census — of which the next one is expected in 2022, a year before the elections — Government has already decided to amend the Constitution to delink the two key exercises.

Government has released US$300 000 for the national roll-out of electronic fuel monitoring devices that will curb malpractices in the petroleum industry.

The Minister of Energy and Power Development Fires the whole ZESA Board

Energy and Power Development Minister Fortune Chasi fired the entire ZESA board for failing to “appreciate the urgency of the situation we are in”. The country is battling acute electricity shortages, and Minister Chasi says the board was not doing much to address the power challenges. In an interview with The Herald Minister Chasi said he will replace the board with people who do not wait for monthly or quarterly meetings to address power challenges confronting the nation. Asked why he had sacked the board, which was only appointed on March 19 this year, Minister Chasi said: “I want people who appreciate the urgency of the situation we are in. Cabinet approved the principles of the Maintenance of Peace and Order Bill

Government continue to align the outstanding laws to the Constitution with Cabinet having approved the principles of the proposed Maintenance of Peace and Order Bill on 19 February 2019, which will repeal the Public Order and Security Act (POSA). 

Cabinet approves repeal of the Access to Information and Protection of Privacy Act (AIPPA)

Cabinet resolved to repeal the Access to Information and Protection of Privacy Act (AIPPA) and amend the Police Act as the Second Republic demonstrates determination to embark on reforms through aligning laws to the Constitution. The repeal of AIPPA will give rise to three legal instruments — the Access to Information Bill, the Zimbabwe Media Commission Bill and the Protection of Personal Information/Data Protection Bill.
